Term and Conditions for Fast Care Transportation's Digital Services Last Updated: October 27, 2025

These Terms and Conditions ("Terms") govern your access to and use of the Fast Care Transportation ("Company," "we," "us," or "our") website, Driver App, and Customer App (collectively, the "Digital Services").

By accessing or using any of our Digital Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the Digital Services.

1. Services Overview

Fast Care Transportation provides a platform for booking and managing non-emergency medical transportation (NEMT) services. The Digital Services facilitate:

  • Customer App/Website: Booking, managing, and paying for NEMT rides.

  • Driver App: Receiving, accepting, navigating, and managing assigned NEMT rides.

Important Note: Fast Care Transportation is a transportation services provider and is not a medical or healthcare provider. Drivers are not medical personnel and are not permitted to administer medical care.

2. User Accounts and Eligibility

A. Account Creation

To use certain features of the Digital Services (e.g., booking a ride or becoming a driver), you must register for an account. You agree to:

  1. Provide accurate, current, and complete information during the registration process.

  2. Maintain and promptly update your account information.

  3. Keep your password secure and confidential.

  4. Immediately notify us of any unauthorized use of your account.

B. Eligibility

You must be at least 18 years old to create a Customer or Driver account. By using the Digital Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Use of Digital Services

A. Acceptable Use

You agree to use the Digital Services only for their intended purpose, which is non-emergency medical transportation and related functions. You must not:

  • Use the Digital Services for any unlawful purpose or in violation of any local, state, national, or international law.

  • Attempt to gain unauthorized access to any portion of the Digital Services or related systems.

  • Interfere with or disrupt the integrity or performance of the Digital Services.

  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

B. Driver App Specific Terms

Drivers using the Driver App acknowledge and agree that:

  • They must maintain a valid driver's license, necessary insurance, and all legally required certifications for NEMT operation.

  • They are independent contractors unless otherwise specified by a separate written agreement with the Company.

  • They are solely responsible for the safety and condition of their vehicle and compliance with all traffic laws.

C. Customer App/Website Specific Terms

Customers using the Digital Services acknowledge and agree that:

  • They must provide accurate information regarding the passenger's mobility, needs, and necessary equipment (e.g., wheelchair, oxygen).

  • They are responsible for any applicable cancellation fees as detailed in the Company's Cancellation Policy.

  • They must treat drivers respectfully. Threatening or abusive behavior is cause for immediate account termination.

4. Financial Terms

A. Fares and Payments

All fares, fees, and charges for transportation services booked through the Digital Services are calculated and displayed within the Customer App/Website. You agree to pay all charges incurred under your account.

B. Billing Information

You must provide valid payment information (e.g., credit card) and authorize us and our third-party payment processors to charge all incurred fees to that payment method.

C. Cancellations and Refunds

The Company reserves the right to charge a cancellation fee if a ride is canceled after a driver has been dispatched or within a specified timeframe of the scheduled pickup. Refund eligibility for canceled or disputed rides is determined solely by the Company's Refund Policy.

5. Disclaimers and Limitation of Liability

A. "AS IS" Basis

THE DIGITAL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COMPANY DOES NOT WARRANT THAT THE DIGITAL SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

B. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAST CARE TRANSPORTATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE DIGITAL SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (iii) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

6. General Provisions

A. Governing Law

These Terms shall be governed by the laws of [Insert State or Jurisdiction where Fast Care Transportation is Registered] without regard to its conflict of law provisions.

B. Termination

We may terminate or suspend your access to the Digital Services immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
